In an August 12, 2012 press release, the U.S. Department of Education (ED) announced the availability of applications for participation in its 2012 Race to the Top – District (RTT-D) competition. On March 26, 2012, a Florida U.S. District Court judge ordered the State Medicaid agency to “provide, fund, and authorize Applied Behavioral Analysis treatment … to all Medicaid-eligible persons under the age of 21 in Florida who have been diagnosed with autism or Autism Spectrum Disorder as prescribed by a physician or other licensed practitioner.” [More]

The Council of Great City Schools (CGCS) held its Legislative and Policy Conference on March 19 – 22, 2011. CGCS, with 66 large urban school district members, hosts the annual conference to provide participants with updates on major federal legislative and policy issues that may impact urban school districts’ operations and finances. Two key issues this year were: The reauthorization of the Elementary and Secondary Education Act (ESEA), and the 2011 federal budget for the U.S. Department of Education (ED). [More]

In Decision No.1924, dated June, 14, 2004, the U.S. Department of Health and Human Services (DHHS) Departmental Appeals Board (DAB) ruled that the “free care principle”, as that term has been defined and applied to school districts by the Centers for Medicare and Medicaid Services (CMS) is not valid and that CMS cannot enforce the principle against school districts. DAB decisions are binding on CMS until appealed to and overturned by the DAB or a federal court. In response to CMS's request for reconsideration, the DAB denied the request and affirmed Decision 1924. [More]

The early and periodic screening, diagnostic and treatment (EPSDT) provisions of the Social Securtiy mandates states to provide health, dental, vision and hearing screening and diagnostic services to Medicaid-eligible children under the age of 21. The states must provide children with treatment services if determined medically necessary through the EPSDT screening and diagnostic process. The states must provide for the treatment services even if the services are not included in their respective state plans for Medicaid. [More]

Medicaid is a public health insurance program established by the federal government for certain low income individuals and families. States that elect to offer Medicaid to its citizens share with the federal government in financing the program. Among other benefits, Medicaid covers inpatient and outpatient hosptal services and medical office visits. Medicaid also covers comprehensive screening, diagnostic and treatment services for Medicaid-eligible children under the age of 21. [More]
