On June 28, 2012, the U.S. Supreme Court upheld the Affordable Care Act (ACA) under a 5-4 decision written by the Chief Justice. The Court's decision has no impact on ACA provisions related to the Exchanges. Florda Federal Judge Stays His Ruling that the Health Reform Law is Unconstitutional

 

The New York Times reports that on March 3, 2011 a Florida federal district court judge ordered a stay of his previous ruling that the health care reform law, the Affordable Care Act (ACA) is unconstitutional. Prior to the Florida ruling, two other federal judges upheld ACA’s constitutionality and another federal judge found it to be partially unconstitutional. [More]

Update on the Health Reform Law as It Moves Through the Federal Court System

 

A fourth federal district court has ruled on the constitutionality of the Patient Protection and Affordable Care Act of 2010 (ACA). On January 31, 2011 a Federal District Court Judge in Pensacola, Florida ruled that ACA violates the Commerce Clause of the U.S. Constitution in that the Act requires every American to obtain health insurance or pay a penalty (called the “individual mandate”). Although the Judge upheld the constitutionality of the Medicaid expansion included in the Act, he ruled that the individual mandate is so intricately bound with the purpose of ACA that the invalidation of the individual mandate invalidates ACA in its entirety.
