The American Public Human Services Association (APHSA) released an unexpected update on January 12 from the Administration for Children and Families (ACF), indicating that revised guidelines for the Guardianship Assistance Program are forthcoming. The revision will allow states to claim Title IV-E reimbursement for children currently in placement in a guardianship setting. Previous interpretation by ACF of the Fostering Connections to Success and Increase Adoption Assistance Act of 2008, limited Title IV-E claiming to children placed after a Title IV-E State Plan amendment has been filed with ACF. This change in ACF instruction has huge ramifications for states in claiming additional Title IV-E funding. Many states are using state funds to pay for placements that have been in place for long periods of time. It is believed that requirements developed by ACF built around new placements will have to be significantly revised since many current requirements will not be met by guardianship placements made prior to October 2008. As states await the release of revised guidelines, PCG can identify states that have yet to submit state plan amendments or to begin analysis for implementing the Guardianship Assistance Program.
